Foreign nationals may obtain lawful permanent residency in the United States through family connections or employment-based opportunities.

Family-based immigration is generally the most direct route, especially for immediate relatives of US citizens. Spouses, unmarried children under 21, and parents of citizens have access to an unlimited number of immigrant visas, avoiding the long waiting periods common in other categories. 

Applicants already in the US can adjust their status by submitting Form I-485, often alongside Form I-130, which establishes the qualifying family relationship. The Child Status Protection Act safeguards eligibility for children who “age out” during the application process.

Beyond immediate relatives, family preference categories cover adult children, siblings of US citizens, and certain relatives of lawful permanent residents, though these categories have annual limits that create longer waiting times. Fiancé(e)s of US citizens may enter through the K-1 visa, requiring marriage within 90 days and subsequent adjustment of status. 

In some cases, K-3 and K-4 visas allow foreign spouses and children to enter the US while family petitions are pending. Employment-based immigration is structured in preference tiers. 

The EB-1 visa is for individuals of extraordinary ability, distinguished academics, and multinational executives. EB-2 serves professionals with advanced degrees or exceptional ability and includes a national interest waiver for work that broadly benefits the country, such as physicians serving underserved areas. 

EB-3 covers skilled workers, professionals, and unskilled labourers. The EB-5 investor visa provides a path for those committing substantial capital, $1.05 million, or $800,000 in designated employment zones, while creating jobs for US workers.

Family-based immigration promotes reunification, while employment-based categories support the country’s need for global talent and investment.
