Kikuyu Elders Secure Court Order Halting Development on Githunguri Sacred Site

The Environment and Land Court has halted construction on a government housing project in Githunguri, Kiambu County, pending the hearing of a constitutional petition.

Justice Ann Mogeni issued conservatory orders stopping all activity on the 58-acre site. The court directed that the status quo be maintained, barring any fencing, excavation, construction, or transfer of the land. Local police have been instructed to ensure compliance.

The case was filed by four petitioners, including representatives of the Maina and Mwangi Trust. They contend that the government began work on the site without consulting the community or conducting public participation. They argue that this violates constitutional protections on cultural heritage and property rights. 

The petition names eight respondents, including the Cabinet Secretaries for Lands and for Gender, Culture and Heritage, the National Museums of Kenya, and the Attorney General. The disputed land, registered as Githunguri/Githunguri/T.801, was acquired in the 1930s by Agikuyu age groups to establish an indigenous college. 

The institution opened in the late 1930s and was linked to nationalist figures such as Mbiu Koinange, Jomo Kenyatta, and James Gichuru. It was closed during the 1952 colonial emergency and later used as a detention site, where Mau Mau fighters were held, tortured, and executed.

Petitioners describe the site as a place of historical and cultural significance. They cite features such as trees planted by Kwame Nkrumah, Kabaka Mutesa II, and Bishop Makarios. 

They also note that structures including the Githunguri Gallows and buildings associated with Kenyatta and Koinange were gazetted as national monuments in 2011, and argue that these protections remain in force. The matter will be mentioned on 6 July 2026, when the court is expected to give further directions. Until then, the land will remain under court protection.
