New Zealand to Tighten Conditions for Open Work Visa Holders from April 2026

New Zealand will introduce new employment conditions for foreign nationals holding open work visas from 20 April 2026, redefining the types of work permitted under these visas.

Open work visas have allowed holders to work for most employers in a wide range of roles and locations without a prior job offer. By contrast, employer-specific visas, such as the Accredited Employer Work Visa, limit migrants to a named employer and position. The revised framework will not affect employer-specific visas or student visas, but it will alter the conditions attached to open work visas.

Under the new system, open work visas will be divided into two categories. The first will allow holders to undertake any form of work, including paid employment, sole trading, or operating a business. This condition will apply to visas such as the Post Study Work Visa and certain partner visas, including those granted to partners of students, workers and New Zealand citizens.

The second category will restrict holders to working for an employer under either an employment agreement or a contract for services. This condition will apply to visas granted to victims of exploitation, asylum seekers and participants in working holiday schemes.

A further restriction will apply to all open work visa holders. They will not be permitted to employ other people, whether directly or through a business they own.

The government has said that existing visa holders may continue their current work arrangements until their visas expire, even if those arrangements would not meet the new conditions. However, future applications will be assessed under the updated rules, and applicants will need to ensure their work or business activities comply with the revised framework.
