Senator Mithika Linturi Accused of Deleting Nude Photos and Videos in Case Where He is Accused of Attempted Rape

Meru Senator Mithika Linturi is under investigation for allegedly tampering with evidence in an attempted rape case against him.

Police constable Keith Robert, the lead investigator in the case, on Wednesday told the court that they are looking into the offense of destroying evidence with respect to the nude photographs and videos linked to the incident.

Keith said detectives believe Senator Linturi was involved in the deletion of the said material, adding that forensic analysis and reconstruction of the evidence on mobile phones are currently ongoing.

"Investigations into the complaint made by the complainant were conducted objectively, conclusively and in the best interests of justice," Keith says in court documents.

“The prayers sought that the application to have the matter before court terminates for failure to provide documents that may not be in our possession would not get the justice that she so rightfully deserves.”

In the application, Senator Linturi wants to be provided with an abstract from Nanyuki Police Station dated January 30th, 2021, as well as nude photographs and videos that the complainant and the prosecution witnesses took at Maiyani Villas Hotel in Nanyuki, where the attempted rape incident allegedly happened.

Officer Keith also told the court that they do not have any abstract of the Nanyuki Police station.

In this case, Linturi is charged with intentionally and unlawfully attempting to rape a 36-year-old woman, and committing an indecent act with an adult contrary to section 11(A) of the Sexual Offences Act. The court heard that Linturi indecently touched the woman’s private parts without her consent.

Linturi, who is eyeing the Meru governor’s seat in the August 9th elections, denied the charges and was released on a cash bail of Sh200,000 or an alternative bond of Sh500,000.
