Evans Kidero Moves to Court to Block Probe into Sh1 Billion Wired to His Bank Accounts

Former Nairobi Governor Evans Kidero has moved to the Appeals Court seeking to stop investigation into his bank accounts over corruption claims.

Last week, the High Court granted Ethics and Anti-corruption Commission (EACC) permission to probe Kidero accounts over Sh1 billion wired to his accounts.

This was after EACC proved to the court that millions of shillings suspected to be from the public coffers were wired to his accounts.

In his notice appeal, Kidero wants the Appellate Court to overturn the decision made by High Court judges; George Odunga, Chacha Mwita and John Mativo last week.

“I am dissatisfied with the whole judgment and orders and desire to appeal,” a notice he filed said.

The EACC has been seeking to investigate transactions into seven bank accounts belonging to the former Governor that allegedly have more than Sh1 billion.

Last week decision by the High Court came after Kidero appealed another order granted to EACC by Magistrate's court, citing violation of his right to property.

“The EACC has the mandate to conduct investigations. There was no malice or contradiction whatsoever within the Constitution regarding its mandate to obtain orders to search individual’s accounts. The search warrants for investigation can be obtained without involving the other party,” the High Court judges ruled last week.

“We find that the third petitioner [Kidero] has not proved the alleged breach of his right to property. Accordingly, we find no basis to hold that there has been a violation of his rights,” the judges added.
