Supreme Court Throws Out Paupers' Petition against President Uhuru's October 26th Victory

A petition seeking to challenge President Uhuru's October 26th victory and filed by two youths has been rejected by the Supreme Court.

The two were seeking to lodge the petition without paying the pre-requisite Sh1.5 million security fee required of anyone filing a petition before the apex court.

Supreme Court Deputy Registrar Daniel Ole Keiuwa said the application by the duo failed to meet the minimum threshold for filing under rule 4 (2) of the Supreme Court presidential Election Petition Rules.

The two, George Bush and John Chengo filed an application known as Forma Pauperis moments to Monday midnight deadline.

A pauper’s brief allows a poor person to present his plea before any court without settling court fees on grounds that they live in poverty.

Meanwhile, another petition challenging the October 26th election was filed by Njonjo Mue and Khelef Khalifa besides that of former Kilome MP Harun Mwau that had been filed earlier.

In their petition, Mue and Khalifa claim that: “IEBC and Wafula Chebukati spectacularly failed to exercise independence while conducting the fresh presidential election.”

Khalifa and Mue filed the petition on behalf of their civil society organisations MUHURI and Kura Yangu Sauti yangu. They seek nullification of Uhuru's victory.

Independent Electoral and Boundaries Commission (IEBC), Chairperson Wafula Chebukati and President Uhuru have been named as 1st, 2nd and 3rd respondents respectively.
